How To Enter: To enter, e-mail to tlphotocontest@aexp.com (i) your full name, mailing address, phone number and email address, (ii) a paragraph (which can be no longer than 1,800 words) about your best picture-taking tip and (iii) a photo that depicts your tip. To be eligible for the Sweepstakes, entries must be received at tlphotocontest@aexp.com between 12:01 AM, Eastern Standard Time (“EST”) on July 17, 2007 and 11:59 PM EST on September 18, 2007 (the “Sweepstakes Period”). Incomplete entries will be disqualified. Only one (1) entry per person/email address; entries with duplicate email addresses or multiple entries using different email addresses for a single individual will be disqualified. All entries and photographs will not be acknowledged or returned. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the authorized account holder of the e-mail account of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Prize (1): Five (5) winners will each receive a Kodak easy Share V750 Dual Lens Digital Camera. Approximate Retail Value ("ARV") for each Prize: $350; Total ARV of all prizes: $1,750. Winners will be responsible for all expenses not specifically included herein, and all applicable federal, state and local taxes. Prize is non-transferable and no substitution by winners or cash equivalent is allowed. Sponsor reserves the right to substitute prize for one of equal or greater value.
Selection Of Winner: Winners will be determined in a random drawing on or about October 2, 2007 (from among all eligible entries submitted during the Sweepstakes Period) conducted by representatives of Sponsor, whose decisions are final and binding in all matters relating to this Sweepstakes. Winners will be notified by telephone, mail or e-mail on or about October 9, 2007, and will be given instructions on how to claim prize. Winners will be required to sign and return an affidavit of eligibility and liability release (and, where permitted, a publicity release) within fourteen (14) days of notification or prize will be forfeited and awarded to an alternate winners. Odds of winning depend on the number of eligible entries received.
Release of Liability: By participating, you release Sponsor, and its subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, and all other associated with the development and execution of this Sweepstakes, from any and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and you agree that these entities are in no matter responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the promotion and/or the awarding of any prize. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, the entrant agrees that, by entering the Sweepstakes, (i) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney’s fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
Additional Rules: By entering, each entrant warrants and represents in connection with the photograph and photograph tip submitted as part of his/her entry that: (a) he/she is the owner; (b) that it is an original: (c) he/she has all necessary rights, including model releases, to grant the rights set forth below; (d) it has not been previously published or submitted in any other Sweepstakes or competitions and/or to any media, including, without limitation, any books, magazines, postcards or calendars; (e) it does not defame or otherwise violate the rights of any third party; and (f) it does not violate any federal, state or local laws or ordinances. Any photograph and photograph tip entered in this Sweepstakes shall remain the exclusive property of Sponsor and entrant agrees that Sponsor and its designees shall have the perpetual, worldwide right to edit, publish and use the photograph and photograph tip in any way and in any media for trade, advertising, promotional and/or other purposes as Sponsor may determine in its sole discretion without further consideration to entrant or winners. Entrant agrees to hold harmless Sponsor, its officers, directors, employees, divisions, affiliates, subsidiaries, advertising and promotional agencies, from any claim by any third party relating to any rights in any photograph and photograph tip submitted. By participating in the Sweepstakes, entrant agrees to be bound by these Official Rules, including all eligibility requirements and all decisions of Sponsor, which are final and binding in all matters relating to the Sweepstakes. Sponsor is not responsible for (a) lost, late, incomplete, illegible, mutilated, damaged, garbled or misdirected entries; (b) telephone, computer, or network malfunction or error; (c) communication disruption or other disruptions related to Internet traffic, virus, bug, worm, or non-authorized intervention; or (d) damage caused by a computer virus or otherwise resulting to any computer from entrant’s access of the Sweepstakes website. In the event the Sweepstakes is compromised in any way, Sponsor reserves the right to cancel the Sweepstakes and to determine the winners from all eligible entries received as of the termination date. Persons found tampering with or abusing any aspect of the Sweepstakes, or whom Sponsor believes to be causing any malfunction, error, disruption, or damage will be disqualified. Sponsor reserves the right to disqualify any unauthorized entries, including, without limitation, multiple entries from the same person. Entering the Sweepstakes constitutes permission to use the entrant’s photograph and photograph tip submitted as part of their entry, name, voice, photo, and likeness of the winner for advertising and publicity purposes, without further compensation.
